NOTE: Birmingham is separated into two DA divisions Jefferson and Bessemer. The case is in Bessemer. I spoke with a nice lady (really) and she took a message. She confirmed Ms. Jones case is under Bessemer but couldn’t tell me if a prosecutor has been assigned.
Marshae Jones was five months pregnant. She was shot. She subsequently miscarried the fetus. She was indicted by a grand jury. Because it was her duty to protect her “unborn baby” and she provoked her assailant.
The white [male] supremacy tool kit includes the following:
Blame the woman for being shot [raped, beaten, etc]
Especially - and this is critical - especially if the victim is a Black woman/WOC
Use language like “unborn baby” when in fact it is a fetus
Use that language for a specific purpose “unborn baby” can be used to advance all sorts of legislation.
The people on board with jailing Ms. Jones are the same people who try and tell Black women that abortion is “Black Genocide” and look at photo of father and daughter face down in a river - dead - scoff:

To be fair, Cornyn said that before the photo of the father/daughter ran, he was simply commenting on the drowning of yet more brown people - apparently taking the “gotta break a few eggs to make an omelet” approach.

(b) Article 1 or Article 2 shall not apply to the death or injuryto an unborn child alleged to be caused by medication or medical care or treatment provided to a pregnant woman when performed by a physician or other licensed health care provider.Mistake, or unintentional error on the part of a licensed physician or other licensed health care provider or his or her employee or agent or any person acting on behalf of the patient shall not subject the licensed physician or other licensed health care provider or person acting on behalf of the patient to any criminal liability under this section.Medical care or treatment includes, but is not limited to, ordering, dispensation or administration of prescribed medications and medical procedures.(c) A victim of domestic violence or sexual assault may not be charged under Article 1 or Article 2 for the injury or death of an unborn child caused by a crime of domestic violence or rape perpetrated upon her.
(d) Nothing in Article 1 or Article 2 shall permit the prosecution of (1) any person for conduct relating to an abortion for which the consent of the pregnant woman or person authorized by law to act on her behalf has been obtained or for which consent is implied by law or (2) any woman with respect to her unborn child.
